AGREEMENT AND RELEASE

2026 SHS Beyond the Classroom: Taiwan New Year Immersion

This Agreement and Release ("Agreement") is entered into between the undersigned participant (and parent/guardian, if applicable) and KICC International Cultural & Creative Co., Ltd. ("KICC") in connection with participation in the 2026 SHS Trip Around Taiwan – Lunar New Year Cultural Exchange ("Program"), taking place from February 13, 2026 (Friday) to February 21, 2026 (Saturday).

Terms and Conditions

1. Itinerary Changes and Limitation of Liability

KICC will make every reasonable effort to follow the published itinerary; however, changes may be necessary for reasons beyond KICC's control. If certain services cannot be provided or itinerary changes are required, additional expenses will be the responsibility of the participant and must be paid promptly. KICC commits to assisting participants in identifying the most cost-effective alternative solutions and will provide prompt, detailed expense breakdowns and clear explanations in such scenarios.

The participant agrees that KICC, its affiliates, officers, directors, employees, agents, and volunteers shall not be liable for any change in schedule, delay, loss, damage, theft, fraud, illness, injury, accident, or expense arising from events beyond its control, including but not limited to acts of God, natural disasters, fire, terrorism, war, strikes, governmental restrictions, riots, political changes, quarantines, customs regulations, or the acts/omissions of transportation or accommodation providers.

2. Independent Contractors

All transportation providers, schools, hotels, and other service suppliers engaged for this Program are independent contractors and are not employees, agents, or partners of KICC.

3. Infectious Disease Policy

In the event of a serious infectious disease outbreak, KICC reserves the right to cancel the trip. In such cases, KICC will refund 80% of the Program fee received by KICC (excluding airfare). As an alternative, KICC may offer participants the option to convert a portion of the remaining program fee (up to the 20% non-refunded amount) into a future program credit, redeemable for future KICC programs, subject to specific terms and conditions. The decision will be based on official announcements from the World Health Organization (www.who.int).

If the participant contracts an infectious disease before or during the trip, they must comply with Taiwanese government health regulations (www.cdc.gov.tw), including isolation or treatment, and will bear any related costs. No refunds or compensation will be provided for any portion of the Program missed due to illness. KICC will endeavor to provide essential administrative assistance and informational support (e.g., connecting with local medical facilities or providing official Taiwanese CDC guidelines) during a participant's illness. Participants are strongly advised to purchase comprehensive travel insurance to cover such unforeseen circumstances.

4. Participant Health Requirements

Participants must be physically and mentally fit for travel and are responsible for monitoring their own health. In the case of a serious medical condition, participants must provide valid documentation from a licensed physician confirming they are fit to travel. KICC assumes no liability for any health-related issues arising during the Program.

5. Optional Insurance

KICC strongly recommends participants purchase additional, more comprehensive travel accidents or health insurance at their own expense. This additional insurance is crucial as it can cover a wider range of unforeseen circumstances not covered by the limited included insurance, such as trip cancellation, extensive medical emergencies, lost luggage, or incidents during independent travel. Participants are responsible for understanding the coverage and terms of any such policy.

6. Media Consent

Participants consent to KICC's use of their statements, photographs, video, and audio recordings for promotional or informational purposes, without compensation. KICC will prioritize the use of group photos and, where feasible, anonymize individual portraits to respect privacy. Participants will be provided an option on the consent form to indicate their preference regarding individual portrait use for external promotional materials. The participant's name may be disclosed to other Program participants.

7. Safety and Insurance Coverage

Participants are expected to exercise caution and common sense at all times. Limited travel accident and sickness insurance is included in the Program fee, covering injuries or illness occurring during KICC-sponsored activities. Detailed policy information for this included limited insurance, including coverage scope, exclusions, and claims procedures, will be provided to participants. KICC is not responsible for incidents during periods of independent travel.

Participation in the Program constitutes an agreement that any claims against KICC will be limited to:

  • 1. The refunds described in this Agreement, and
  • 2. Amounts actually paid under the insurance policy provided for the Program, subject to all policy terms, conditions, and limits.

8. Passport and Visa Requirements

Participants who are not U.S. passport holders are responsible for obtaining any required visas or travel documents and should consult the Taipei Economic and Cultural Office in San Francisco for details. KICC will provide periodic friendly reminders regarding visa and entry requirements after enrollment to assist participants in preparing in advance. KICC is not responsible if entry is denied by immigration authorities. Program fees are non-refundable in such cases.

9. Travel Risks and Advisory Notices

Enrollment and payment for the Program constitute acceptance of the risks inherent in international travel. The participant acknowledges that global events, travel advisories, or health concerns may require changes to accommodations, itinerary, or even cancellation of the trip. KICC commits to continuously monitoring safety conditions and health advisories for the destination, and will promptly communicate relevant risks and KICC's response measures to participants upon receiving official warnings.

10. Right to Adjust Itinerary

KICC reserves the right to adjust or change the itinerary in the interest of Program operation and participant safety.

11. Governing Law and Severability

This Agreement is governed by the laws of the State of California. If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
